Terms of Service

These terms govern your use of DMLoop (the “service”). By creating an account or using the service, you agree to these terms. If you disagree with any part of them, you may not use the service.

The service

DMLoop lets you connect an Instagram Business or Creator account and automate replies and direct messages in response to comments, story replies, and mentions, and view analytics about that activity.

Your account

• You are responsible for the activity under your account and for keeping your credentials secure.
• You must provide accurate information and be authorized to connect any Instagram account you add.
• You must be at least 13 years old (or the minimum age in your jurisdiction).

Acceptable use

You agree not to use the service to:

• Send spam, harassment, or unlawful, deceptive, or harmful content.
• Violate Instagram’s or Meta’s Platform Terms and policies, or any applicable law.
• Attempt to disrupt, reverse-engineer, or gain unauthorized access to the service.

You are solely responsible for the messages your automations send and for complying with Meta’s policies and messaging rules, including the Instagram 24-hour messaging window.

Instagram and Meta

The service relies on Meta’s platform and APIs. DMLoop is not affiliated with, endorsed by, or sponsored by Meta or Instagram. Your use of connected accounts remains subject to Meta’s terms, and Meta may change or restrict its APIs at any time, which may affect the service.

Plans and billing

Paid plans, where offered, are billed in advance and are described at the point of purchase. Fees are non-refundable except where required by law.

Payments are processed by one or more third-party payment service providers, payment aggregators and/or payment gateways licensed by the Reserve Bank of India (collectively, “PSPs”). By initiating a payment, you authorise IvoryTusk Technologies Private Limited and our PSPs to process the transaction on your behalf in accordance with the PSP’s own terms. We do not store full payment-card details on our servers; such data is handled directly by the relevant PSP over PCI-DSS-compliant channels.

Termination

You may stop using the service and delete your account at any time. We may suspend or terminate access if you violate these terms or to protect the service or other users.

Disclaimers and liability

The service is provided “as is” without warranties of any kind. To the maximum extent permitted by law, DMLoop is not liable for indirect, incidental, or consequential damages, or for any loss arising from your use of the service or from changes to Meta’s platform.

Changes to these terms

We may update these terms from time to time and will update the “Last updated” date above. Where a revision is material we will try to give at least 30 days’ notice before it takes effect. Continued use after changes means you accept them.

Governing law

These terms, and any dispute, claim or proceeding arising out of or in connection with them (including their formation, validity, interpretation, performance or termination), are governed by and construed in accordance with the laws of India, without regard to its conflict-of-law principles.

Dispute resolution

If a dispute arises, please first contact us at contact@ivorytusk.co.in. If it cannot be resolved through good-faith discussion within thirty (30) days, the dispute shall be:

• referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996;
• seated at Surat, Gujarat, India, before a sole arbitrator mutually appointed by the parties, and conducted in the English language; and
• subject, in all other respects, to the exclusive jurisdiction of the competent courts at Surat, Gujarat, India.
